Police Release Video from In-N-Out Shooting

ELK GROVE, CA (MPG) - The Elk Grove Police Department last Thursday released body-worn camera footage showing the April 12 police shooting of Jerry Tolliver Jr., 50, outside an In-N-Out Burger on East Stockton Boulevard.
The eight-minute video, compiled by the department, shows officers confronting Tolliver after receiving reports of a man acting erratically and possibly carrying a weapon in the parking lot.
A customer inside the restaurant had called 911 around 11:13 p.m., saying an individual was inside the In-N-Out harassing juveniles and “acting erratically,” according to the video.
“It looks like it might be the butt of a gun, like, in his pocket,” the caller said.
Four officers responded to the scene, three approaching from Bond Road and one already in the parking lot. Video shows officers shouting commands at Tolliver, who was seated outside the restaurant at a table.
“Hands up. Hands up. Get your hands out of your f------ pockets!” one officer can be heard yelling.
Moments later, another officer fired multiple shots. Police said Tolliver had a .38-caliber revolver in his right hand as he ran between parked vehicles while officers arrived to the scene. Body-cam and dash-cam footage shows him raising what police identified as the firearm toward officers before police fired at Tolliver.
According to the video, a camera on a parked vehicle recorded Tolliver exiting the restaurant, at one point waiving the firearm about his head.
The revolver recovered at the scene was loaded with six rounds, police said.
Tolliver was seriously injured and remains hospitalized. Police said he faces charges of assault with a deadly weapon on a peace officer and being a felon in possession of a firearm once he is released from care.
None of the officers were injured during the encounter.
Earlier this week, Tolliver’s family and advocates held a briefing outside Kaiser South Sacramento Medical Center, saying they had not been informed of his condition or whereabouts for several days.
Lisa Schenk, of the local advocacy group EMPACT, said in a statement that the experience had been “emotionally devastating” for Tolliver and his family.
“Many details surrounding the incident remain unknown,” Schenk said, adding the family’s current focus is ensuring Tolliver receives proper medical care.
The shooting remains under investigation by Elk Grove Police’s professional standards bureau and the Sacramento County District Attorney’s Office.
