Protestors Await Verdict on Governor Newsom’s Legislative Edicts

YUBA CITY, CA (MPG) - Civic Center Blvd was packed with hundreds of protestors peacefully asserting their constitutional rights and expressing their disgust for California’s Governor Newsom as the trial between the Governor and Assemblyman James Gallagher and Assemblyman Kevin Kiley kicked off at the Sutter County Superior Court Wednesday, October 21st.

Judge Sarah Heckman led the proceedings which focused on Gallagher and Kiley challenging Governor Newsom’s executive order No. N-67-20 requiring counties to mail all eligible voters vote-by-mail ballots. The executive order is just one instance in where many believe that the California Governor has overstepped legislative boundaries and enforced unconstitutional edicts on the residents of the state.

In his opening statement to the Court, Gallagher stated that this case was “about the most fundamental cornerstone of our system of Government, the separation of powers.” continuing to share that in his view, the actions made by the Governor under his assertion of the California Emergency Services Acts power has threatened the checks and balances of power put in place by our founding fathers and are unconstitutional. His co-plaintiff, Assemblyman Kiley, referenced a quote by James Madison included in the brief submitted to the court, “The accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly pronounced the very definition of tyranny.” Kiley claims that Governor Newsom himself stated the Emergency Services Act “ quote: centralizes the state’s powers in the hand of the government,” with Kiley continuing in his own words, “So the defendant maintains that the California Emergency Services Act does the very thing that the father of the US Constitution described as the definition of tyranny, and that our state constitution expressly forbids…..The laws of the state of California do not countenance an autocracy under any circumstances. They do not allow for one-person rule. They do not empower a governor to legislate – not for one day, and certainly not for eight months.”

Governor Newsom did not attend the proceedings and the case to be pleaded by defendants on his behalf.

Outside, residents from all over California who had gathered at the courthouse were prepared to wait as long as it took, hoping for the judge to rule in Gallagher, Kiley and “freedom’s favor”.  John and Gail Rogers from Red Bluff made the drive because “We believe in freedom of the people and not tyranny from the governor.” From all present came a steady stream of statements “We want Newsom out of office”, “Freedom!”, “This tyranny needs to go!” Michelle, a beautician from Martinez who had lost her livelihood in the state’s shut down and nearly her home, passionately declared “I will be okay when trump wins, and when Gavin Newsom is recalled and my God given liberties and freedoms are restored!”

Unfortunately, Judge Heckman was unable to declare a verdict Wednesday leaving Assemblyman Gallagher, Assemblyman Kiley and the public waiting on her ruling. In a post of Facebook, Gallagher said he hoped that the ruling would come before the end of the week. “Kevin and I are doing this for you.” He continues, “We’re doing this so that California can be governed by its People, not by dictates from one man.”
